Terms of use

1. Scope and provider

These terms apply to the use of the Discord bot Sidekick and its web dashboard at sidekickbot.de. The provider is Timon Sost (address in the imprint).

By inviting Sidekick to a server or logging in to the dashboard you accept these terms. Discord’s terms of service and guidelines apply as well.

2. Service

Sidekick can be used free of charge. There is no claim to particular features or to constant availability; maintenance and outages at Discord or the host can cause interruptions. We may develop, change or discontinue features. Protection features (moderation, Automod, anti-raid, anti-nuke, verification) stay free.

3. Duties of server owners

Whoever invites Sidekick or sets it up in the dashboard follows Discord’s terms and guidelines, informs the server’s members appropriately about the features in use (e.g. logs, message copies) and ensures a valid legal basis where they decide on the processing themselves.

4. Prohibited use

Sidekick must not be used for illegal content, harassment, spam or fraud, to get around security features, to overload or attack the service, or to scrape the dashboard or its interfaces automatically.

5. Content

The server concerned is responsible for content posted through Sidekick (e.g. welcome messages, embeds, scheduled messages, auto-responses, own puzzles). Decisions on moderation, bans and appeals are made by the server’s team alone. We may remove content that violates these terms or applicable law.

6. Premium

Premium is still being set up. Its terms will follow as soon as Premium goes live.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.

For slight negligence we are only liable for breaching an essential obligation whose fulfilment makes proper use possible in the first place and on which you may regularly rely (cardinal obligation); liability is then limited to the foreseeable damage typical for this kind of service. Otherwise liability for slight negligence is excluded.

For loss of data we are only liable to the extent that would have occurred with usual, regular backups. We are not liable for content and actions of server teams and members, or for outages at Discord.

8. Term and termination

A server can remove Sidekick at any time; that server’s data is then deleted after 30 days. We may restrict or end the use by individual servers or people who violate these terms.

9. Changes to these terms

We may adjust these terms, e.g. for new features or a change in the law. We announce significant changes in good time, e.g. on the support server or in the dashboard. If you keep using Sidekick afterwards, the new terms apply.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected. If the user is a merchant, the place of jurisdiction is the provider’s place of business.
